The primary contract governing a customer's paid subscription to the flowbit platform.
1. Agreement to terms
This Master Subscription Agreement ("Agreement") is entered into between flowbit, Inc. ("flowbit", "we", "us") and the customer or user that accesses the flowbit developer cloud platform and related services (the "Services"). By accessing or using the Services, you agree to be bound by this Agreement.
If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, in which case the terms "you" and "your" refer to that entity.
2. Use of the Services
Subject to your compliance with this Agreement, flowbit grants you a non-exclusive, non-transferable, revocable right to access and use the Services during the applicable subscription term.
- You are responsible for all activity that occurs under your account.
- You will maintain the confidentiality of your account credentials.
- You will use the Services only in accordance with applicable law and this Agreement.
3. Fees and payment
Fees for the Services are described in the applicable order form or pricing page. Unless otherwise stated, fees are non-refundable and payable in advance. flowbit may suspend access for overdue amounts after reasonable notice.
4. Term and termination
This Agreement remains in effect for the duration of your subscription term. Either party may terminate for material breach that remains uncured 30 days after written notice. Upon termination, your right to access the Services ceases.
5. Disclaimers and liability
The Services are provided "as is" without warranties of any kind to the maximum extent permitted by law. To the extent permitted by law, neither party's aggregate liability arising out of this Agreement will exceed the fees paid in the twelve months preceding the claim.
